Madison Garrett

Madison is a member of Choate’s Intellectual Property Litigation group. She represents a variety of clients in commercial disputes and intellectual property matters, including patent litigation.

While in law school, Madison worked on complex litigation matters through various legal internships. As part of her legal internship with the Office of General Counsel at Boston Children’s Hospital, Madison worked on behalf of the Medical Legal Partnership to ally health care providers with lawyers to improve the health and well-being of vulnerable populations.

Representative Engagements

  • Represent biopharmaceutical companies in Hatch-Waxman patent litigation.
  • Advise biopharmaceutical company regarding license agreement, infringement issues and associated litigation risks.
  • Counsel for company in contract dispute that went to multi-week arbitration, resulting in very favorable award to client.
  • Obtained preliminary injunction for leading bank in action involving breach of contract and fraud.
  • Counsel for construction company and private investor in an action alleging bad faith, intentional misconduct, and breach of contract related to a real estate development in Boston, MA.
  • Assisted biotechnology company with responding to petition for post-grant review at the PTAB.
  • Performed Safe Harbor analysis and provided assessment of likelihood of patent infringement.
  • Represented individual through Lawyer’s Clearinghouse Legal Clinic in social security proceeding presided over by an Administrative Law Judge and obtained fully favorable decision for client.
